JVLNET Internet Services, is a local Internet service provider, referred to hereinafter as JVLNET. Subscriber is any person, persons, or business that accesses JVLNET in any way, and includes the signee, friends, family, employees, and/or any other person, persons, or business who have access to and/or uses subscribers JVLNET logon ID. No more than one connection may be used at the same time for any one given Subscriber Logon ID. Because of the nature of the Internet and its composition, the operators of JVLNET can exercise no control whatsoever over the content of the information passing through or stored on its systems. It is therefore entirely left up to the discretion of subscriber to judge whether the information accessed is appropriate material. Use of any information, programs or data obtained from or via JVLNET is at subscribers own risk. JVLNET specifically denies any responsibility for the accuracy or quality of information obtained through its services. JVLNET makes no warranties of any kind, whether expressed or implied, for the service it is providing. JVLNET disclaims any warranty of merchantability or fitness for a particular purpose. JVLNET will not be responsible for any damage suffered by subscriber from use of its service including, but not limited to, loss of data, delays, misdeliveries, or service interruptions caused by any reason, including negligence, by JVLNET, its employees, its carriers, its other subscribers, or by the subscribers own errors or omissions. Subscriber understands that all JVLNET usage plans, including those called "unlimited", except those called "preferred", can not exceed eight hours in any one dial-up session, and that JVLNET may automatically terminate, without any further notice, a session exceeding the eight hour per session limit as well as a session with ten minutes of inactivity. Subscriber also understands that JVLNET will go off line from time to time, usually during off-peak hours, and without any further notice, to do normal maintenance, backups, or for any other reason. Subscriber may not resell any access to JVLNET under any circumstances whatsoever. Subscriber may not add, delete, modify, move, run, store, or copy any file or program to or from any of the JVLNET Servers for any reason without the express written permission of JVLNET. JVLNET will remove any such found files and the responsible User ID, and will report all such unauthorized use, abuse, or hacking to the proper authorities for prosecution. JVLNET's services may only be used for lawful purposes. Transmission of any material in violation of any US, state, or international regulation is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret. Subscriber agrees to indemnify and hold harmless JVLNET from any claims resulting from subscribers use of this service which causes damages to subscriber or another party. Any access to other networks through JVLNET must comply with the rules appropriate for that network. Charges for JVLNET access are automatically billed in advance, on or about the first of the month, at the pre-established rates, and using the pre-agreed payment method, plus taxes. Statements will be supplied via e-mail to your user account only upon request. Any invoiced account remaining unpaid 15 days past the start date of the billing period may be suspended until paid in full, and without credit to subscriber for any lost time due to suspension. Accounts 30 days past due will be deleted and subscriber will loose all related files and e-mails in their account. Subscriber may cancel subscription to JVLNET upon written notice to JVLNET at least 30 days prior to the end of the specified number of months agreed for JVLNET services. If there is no specified number of months for JVLNET service, then subscriber must cancel service with at least 30 days written notice prior to the beginning of a new billing period. A new billing period is always extended to the first of the month following the date the subscriber requested JVLNET service. There is no credit or pro-rating for partial months. Subscriber remains fully liable for all charges incurred up to 30 days past the date JVLNET receives proper notice of cancellation. No credit, or refund, will be given for any prepaid fees, regardless of the reason for cancellation, including, but not limited to inability to be able to actually access JVLNET, dial in, log on, send or receive e-mail, or use the Internet as expected. JVLNET reserves the right to change the rates and the Terms and Conditions at any time. All new and existing accounts are subject to the approval of JVLNET. Any account found to be in noncompliance with these Terms and Conditions is subject to immediate suspension or termination without notification, refund to the subscriber, or any other obligation to subscriber from JVLNET. The terms and conditions of this agreement, along with the Customer Information Sheet for Internet Access, constitute the entire agreement between JVLNET and the subscriber. |
