Terms and Conditions:

JVLNET Internet Services, is a local Internet service provider, referred to hereinafter as JVLNET.

Subscriber is any person, persons, or business that accesses JVLNET in any way, and includes the signee, friends, family, employees, and/or any other person, persons, or business who have been issued or have access to and/or uses a JVLNET Username or password.

No more than one connection may be used at the same time for any one given Subscriber Login Username, unless the subscriber has paid an additional fee for a Multi-Login account.

No one is authorized or allowed to use JVLNET to send "SPAM" email, or email in bulk to unsolicited persons that has content that was not specifically requested by the recipient, or email that is sent to, copied to, blind copied to, or sent from a bogus email address. Any person found sending such SPAM email, as solely defined by JVLNET, is subject to a pre-defined fee of $10 per email address up to a maximum fee of $200 per day.

Because of the nature of the Internet and its composition, the operators of JVLNET can exercise no control whatsoever over the content of the information passing through or stored on its servers. It is therefore entirely left up to the discretion of subscriber to judge whether the information accessed is appropriate material. Use of any information, programs or data obtained from or via JVLNET is at subscribers own risk. JVLNET specifically denies any responsibility for the accuracy or quality of information obtained through its services.

JVLNET makes no warranties of any kind, whether expressed or implied, for the service it is providing. JVLNET disclaims any warranty of merchantability or fitness for a particular purpose. JVLNET will not be responsible for any damage suffered by subscriber from use of its service including, but not limited to, loss of data, delays, misdeliveries, or service interruptions caused by any reason, including negligence, by JVLNET, its employees, its carriers, its other subscribers, or by the subscribers own errors or omissions.

Subscriber is responsible for any and all telephone and local or long distance charges to access JVLNET. JVLNET IS NOT RESPONSIBLE FOR ANY OF SUBSCRIBERS TELEPHONE OR TELEPHONE RELATED CHARGES. If Subscriber is not sure if a specific JVLNET access number is a local call they should contact their local phone company.

Subscriber understands that all JVLNET usage plans, including those called "unlimited", except those called "preferred" or "continuous", can not exceed eight hours in any one dial-up session, and that JVLNET may automatically terminate, without any further notice, a session exceeding the eight hour per session limit as well as a session that has exceeded twenty minutes of inactivity. Subscriber also understands that JVLNET will go off line from time to time, usually during off-peak hours, and without any further notice, to do normal maintenance, backups, or for any other reason. There is will be no credit to Subscriber unless off line time exceeds 24 hours in a given month and credit will not exceed one month access fees that were pre-paid by Subscriber. Subscriber may not resell any access to JVLNET under any circumstances whatsoever.

Except for in Subscribers personal email and webpage directory, Subscriber may not add, delete, modify, move, run, store, or copy any file or program to or from any of the JVLNET Servers for any reason without the express written permission of JVLNET. JVLNET will remove any such found files and the responsible User ID, and will report all such unauthorized use, abuse, or hacking to the proper authorities for prosecution. JVLNET also has the right to remove, without any further notice, any email on JVLNET's servers, read or not read, after 90 days, and any single email over 1 MB after 10 days, any email in excess of 10 MB total after 1 day, and any email in excess of 20 MB total.

JVLNET's services may only be used for lawful purposes. Transmission of any material in violation of any US, state, or international regulation is prohibited. This includes, but is not limited to, copyrighted material, threatening or obscene material, or material protected by trade secret. Subscriber agrees to indemnify and hold harmless JVLNET from any claims resulting from subscribers use of this service which causes damages to subscriber or another party. Any access to other networks through JVLNET must comply with the rules appropriate for that network.

JVLNET reserves the right to automatically add a JVLNET SpamFilter and/or JVLNET VirusFilter at any time and without notice. The Subscriber will always have the right to turn off the filters at any time. JVLNET is not responsible for the loss of any email for any reason.

All JVLNET services and subscriptions are automatically renewing and Subscriber gives JVLNET permission to automatically charge the Subscribers credit card or bank account in advance, on or about the first of the month, at the pre-established subscription rates, for the pre-agreed service terms (monthly, quarterly or annually), and using the pre-agreed payment method (Visa, Master Card, or Discover), plus taxes. Statements will be supplied only upon request, and normally by email only, delivered to your JVLNET email address, or any other given email address, about 15 days before due date. Accounts not automatically charged to a credit card or bank account are responsible for making payments to be received by the first day of the billing period. If JVLNET has current credit card or bank information on file, and an invoiced account is not paid in full by the due date, then JVLNET will automatically charge subscribers credit card or bank account the full amount due on or about 10 days after the due date. All accounts not paid on time are subject to a late fee of $5 or 18% APR, which ever is greater.

Any account remaining unpaid 10 days past the start date of the billing period may be suspended until paid in full, without any further notice, and without any credit to subscriber for any lost time due to suspension. Accounts 30 days past due will be scheduled for deletion and subscriber will lose all related files and e-mails in their account. JVLNET is not responsible in any way for any lost email, data, or files. There is a $15 re-activation fee. FAILURE TO MAKE PAYMENT IS NOT AN ACCEPTABLE METHOD OF CANCELLATION AND WILL NOT RELIEVE YOU OF YOUR OBLIGATION TO PAY. IF IT IS YOUR INTENSION TO CANCEL YOUR JVLNET SUBSCRIPTION, YOU MUST DO SO ACCORDING TO THE TERMS BELOW..

Subscriber may cancel subscription to JVLNET only upon written notice to JVLNET, and at least 30 days prior to the end of the specified number of months agreed for JVLNET services. Email notices will be considered same as written notice. If there is no specified number of months for JVLNET service on the face of this agreement, then subscriber may cancel service with at least 30 days written notice prior to the beginning of a new billing period. A new billing period is always extended to the first of the month following the date the subscriber requested JVLNET service. All 12, 24, 36, and 60 month initial term agreements will automatically renew for another 12 month period and every 12 months thereafter. There is no credit for partially unused months. Subscriber remains fully liable for all charges incurred up to 30 days past the date JVLNET received proper notice of cancellation. No credit, or refund, will be given for any prepaid fees, regardless of the reason for cancellation, including, but not limited to inability to be able to access JVLNET, dial in, log on, send or receive email, or use the Internet as expected. THERE ARE NO REFUNDS

JVLNET reserves the right to change the Terms and Conditions at any time. The current Terms and Conditions are posted on www.jvlnet.com. All new and existing accounts are subject to the approval of JVLNET. Any account found to be in noncompliance with these Terms and conditions is subject to immediate suspension or termination without notification, without any refund to the subscriber, and without any other obligation to subscriber from JVLNET.

The terms and conditions of this agreement, along with the Subscribers Information and any approved attachments, constitute the entire agreement between JVLNET and the subscriber.
